    D’autres pays sont dans l’incapacité de garantir les droits économiques, sociaux et culturels des enfants...

    Does this signify an actual incapacity... or does it mean they they fall short in doing this (guaranteeing the economic and other rights of children)

    "ils sont dans l’incapacité de" is the correct way of saying "ils ne peuvent pas".
    What you want here is a correct phrase for "they can't".
