action au fond / en référé

    In France when your bring an action against someone you can chose

    une action au fond
    une action en référé

    The "action en référé" called summary proceedings is a special emergency procedure to prevent imminent prejudice, or illicit activities

    Pour "saisir un Tribunal en référé" I woul say to submit a matter to summary proceedings.

    The "action au fonds" is the normal process for the law suit

    But how to say "une action au fond"

    Its a full hearing (of the merits of the case).

    Rather:
    "ask for a full hearing (of the merits) of the case" (ce que fait le plaignant)
    "refer the case for a full hearing" (ce que fait le juge).

    Entre autres possibilités :

    "Engager une action au fond" = "To institute substantive proceedings"

    "Engager une action en référé" = "To start interim proceedings"

    I've been going through this thread and I'm wondering also about a "demande au fond"? Wuuld that be a request for full hearing on the merits of the case? Thank you for the feedback...:))
