The "action au fonds" is the normal process for the law suit But how to say "une action au fond"
Rather: "ask for a full hearing (of the merits) of the case" (ce que fait le plaignant) "refer the case for a full hearing" (ce que fait le juge).
Entre autres possibilités : "Engager une action au fond" = "To institute substantive proceedings" "Engager une action en référé" = "To start interim proceedings"
