capitulate/surrender

I find the definition is---surrender under agreed conditions,

But, which side's condition? Does the losing side get to have any advantage out of it? Or just the winning side who makes the treaty?
What's is different from Surrender?

    I would take "capitulate" as meaning yielding with no conditions attached, but "surrender" requiring the discussion of conditions. There is also the term "unconditional surrender" which is self-explanatory.
