Hi,

I have to translate the formula “contratti d'appalto o d'opera o di somministrazione” as in the title page of this document:

LA SICUREZZA DEL LAVORO NEI CONTRATTI D’APPALTO O D’OPERA O DI SOMMINISTRAZIONE

I’m having some trouble working out how, or indeed whether, to distinguish the first two categories in translation. The same document describes both of them:

l'appalto è il contratto con il quale una parte assume, con organizzazione dei mezzi necessari e con gestione a proprio
rischio, il compimento di un'opera o servizio verso un corrispettivo in denaro

il contratto d'opera si configura quando una persona si obbliga verso "un'altra persona fisica o giuridica" a fornire un'opera o un servizio pervenendo al risultato concordato senza vincolo di subordinazione nei confronti del committente

The WR dictionary has:

appalto - Contratto col quale una parte assume a proprio rischio il compimento di un’opera o di un servizio dietro un corrispettivo in denaro

Contratto d’opera - che ha a oggetto la prestazione di un’opera o di un servizio dietro pagamento di un corrispettivo

Both sets of definitions make the distinction of the risk assumed, so I guess that’s the key to it. The first set seems to indicate more subtle differences, between parties and persons, who organises it, who’s in charge. I suspect that these definitions don’t have equivalents in English, and I could call both of them “contracted work” indifferently. The trouble is that I’m not sure. Can anyone help?

That’s a new one on me: I don’t think so. I see that translated as garanzia di buon fine/buona esecuzione or left in English.

I think a tender is an offer to perform work for a certain price, isn’t it? So I’m not sure where it fits into the distinction, and I’m not sure that whether the works are public or not is relevant either.

Ciao Mark, the way I read that title is that we have the 'Contratto d'appalto', which then may be divided into two categories: the 'Contratto d'opera' and the 'Contratto di somministrazione'. Here we have the definitions of these two contracts but honestly I wouldn't know if there is an equivalent in English. There are also some threads on 'somministrazione' as used in your title, but they don't help much.
However, the important point here is that in the 'Contratto d'opera' the contract refers to a one-off work, whereas the 'Contratto di somministrazione' involves a repeated work (or supply of goods). For example, staff leasing on a periodic basis would be a good example of a 'Contratto di somministrazione'.

Un termine generico che vedo utilizzare in inglese è service contracts. Questa definizione può coprire sia i contratti d'opera, sia forse i contratti di somministrazione, sia i contratti d'appalto diversi dagli appali in edilizia (che si chiamano construction contracts). Non conosco definizioni più specifiche per i diversi tipi di contratto e sarei anch'io interessato a conoscerle.

Oh yeah, that would explain the two o’s I suppose. I was leaning towards not distinguishing them in the translation anyway, so that’s very helpful.

Yeah, I got “supply contract” straight out of the (my) dictionary for that one.
