faire valoir ses droits

Hi,

I need help in translating the following phrase:

Le défaut de l'une des parties de faire valoir ses droits au titre du contrat.

My try would be: The default of one of the parties to prove up on its rights as part of the contract.

    Hello everybody !

    I have a little problem translating the expression "faire valoir ses droits" in english ! In this sentence, it's about someone who had problems with his computer, and he wants repair of the damages, he'd like to "faire valoir ses droits auprès du fabricant".
    I hope I was clear !

    I think Mr. Bradford has the right idea. So you could say, "X would like to make a warranty claim against the manufacturer". Obviously, this translation only works if the computer is still under warranty.

    More generally, the term means "exercise his rights (against the manufacturer)"; you might want to stay with that if the nature of the rights, and how they are to be exercised, is not specified.
