Hello,

How do you understand the last part of this extract:

No liability shall result from delay in performance caused by circumstances beyond the reasonable control of the party affected, including but not limited to acts of God, fire, flood, war, government action, accident, labor trouble or shortage, inability to obtain material upon reasonable prices or terms, equipment or transportation.

Is it:
inability to obtain material, equipment or transportation [upon reasonable prices or terms].

or

inability to obtain material [upon reasonable prices or terms], equipment or transportation

or
inability to obtain material [upon reasonable prices or terms, equipment or transportation]

thanks

When it comes to contracts or agreements, what matters is how a lawyer or a judge will read something. We are not equipped to give legal advice here and it is outside the scope of our forum.
