Hi,

Please advise,

What is the meaning of the underlined?

Thanks,

A.

In addition to the terms implied by common law or statute, the Supplier shall guarantee the machinery or material to fulfil the requirements as regards tests, inspection and analysis enumerated in the Purchase Order and to replace all parts not fulfilling these requirements or proving faulty owing to defective material, design or workmanship for a defects liability period of twenty four (24) months from date of delivery or twelve (12) months from being put to work, whichever is the longer. In respect of Goods replaced as aforesaid all guarantees are to be renewed from the date the replaced Goods are put into use by XX.

My understanding -
In addition to the terms implied by common law or statute, the Supplier shall guarantee that the machinery or material will fulfil the requirements as regards tests, inspection and analysis enumerated in the Purchase Order and the Supplier shall also quarantee that such machinery and material (which meets the tests) will be used for replacement of all parts not fulfilling these requirements or proving faulty owing to defective material, design or workmanship for a defects liability period of twenty four (24) months from date of delivery or twelve (12) months from being put to work, whichever is the longer. In respect of Goods replaced as aforesaid all guarantees are to be renewed from the date the replaced Goods are put into use by XX.

the Supplier shall guarantee the machinery or material = the Supplier must give us a guarantee that the machinery or material will fulfill.

Can I divide it as follows?

In addition to the terms implied by common law or statute, the Supplier shall guarantee the machinery or material 1) to fulfil the requirements as regards tests, inspection and analysis enumerated in the Purchase Order and 2) to replace all parts not fulfilling these requirements or proving faulty owing to defective material, design or workmanship for a defects liability period of twenty four (24) months from date of delivery or twelve (12) months from being put to work, whichever is the longer. In respect of Goods replaced as aforesaid all guarantees are to be renewed from the date the replaced Goods are put into use by XX.
